According to Slashdot

SCO has released the use of the 80 lines of code that was stolen, and allegedly it is used in multiprocessor systems, which what has been the believed purpose for a while now, probably nothing that we didn't already know.

However, there is a paper trail, and it does appear, at least to me, that it is a remote possibility and that the code may have been stolen.  I do not agree that SCO should be bashing Linux and open source and raising kane over their suit against IBM.

The one redeeming thing that came from this article is that the code in question was submitted to the development kernel (2.5), and therefore, not used in production corporate systems or distributed w/ distros, leaving SCO no legal action against corporations who use and distribute Linux.  After all, the code is not in the kernels that they're distributing.

Torvalds has put a code freeze on the kernel at this point, I believe, somebody please verify this.  Therefore, the next stable 2.6 is not going to come out until after this case is settled, and by that time the code in question will hopefully be out, giving SCO no legal claims.
