Potentially.  However, if SCO gets its ass kicked by IBM, they will likely go bankrupt.

To be honest, I start to wonder if SCO boys really are, as Linus put it, "smoking crack."  When they bought ancient AT&T unix, they bought the BSD settlement.  It's insane to challenge it ten years later.

the BSD layer in Mac OS X is governed under a license that was negotiated in the late 1980s when NeXT, Inc. built NeXTStep.

Besides, all they'd have to do is drop the BSD utilities and build their own replacements. Apple owns MACH. The kernel isn't BSD code, it's a microkernel that implements BSD structures. Then there's the BSD subsystem, which is all the unix utils... an optional install... and then all the high-level Objective-C stuff.

besides, the BSD stuff has been tested in court already. AT&T lost big. SCO is nothing but a bunch of whiny bitches who like to jack off to pictures of shitty american SUVs. They like to drink each others' cum and gargle it in front of a mirror.
