MS-DOS is not open source, and also it is officially abandonware. However DR-DOS is not, and neither is FreeDOS. both are open source. FreeDOS is released under the GPL, and DR-DOS is released under either a free closed source licence or a paid for restricted open source licence.

i didn't. i don't have the source for it, however if you visit http://drdos.com/ (http://drdos.com/products.html) you will see that DeviceLogics (current owners and vendors of DR-DOS) are officially offering their DOS source code to paying licenced customers.

restricted and will probably be like those horrible AT&T nondisclosure licences, but it's basically halfway between microsoft's shared source farce and real open sourceness.
